Terms of Service

Welcome to Experia. These Terms of Service ("Terms") govern your access to and use of Experia's websites, applications, and services ("Services"), including CreatorOS, Ticketnation, VenueOS, and related products.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By creating an account, making a purchase, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy.

2. Description of Services

Experia provides a platform that enables:

  • Creators: Tools to create, manage, and sell tickets for events, manage memberships, and build communities
  • Consumers: Discovery and purchase of event tickets and experiences
  • Venues: Management of bookings, inventory, and operations

3. Account Registration

3.1 Account Creation

To access certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

4. User Conduct

When using our Services, you agree not to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others, including intellectual property rights
  • Post false, misleading, or fraudulent content
  • Engage in harassment, abuse, or harmful conduct
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Services
  • Use automated systems to access the Services without permission
  • Resell tickets in violation of our policies or applicable laws

5. Event Organizer Terms

5.1 Organizer Responsibilities

If you use our Services as an event organizer, you agree to:

  • Provide accurate and complete information about your events
  • Honor all commitments made to ticket purchasers
  • Comply with all applicable laws and regulations
  • Handle refunds and cancellations in accordance with our policies
  • Maintain appropriate insurance for your events

5.2 Fees and Payments

Organizers agree to pay the applicable fees for using our Services. Fees are deducted from ticket sales or invoiced according to your service agreement. All fees are non-refundable unless otherwise specified.

6. Ticket Purchases

6.1 Purchase Terms

When you purchase tickets through our platform, you enter into a transaction with the event organizer. We act as an intermediary to facilitate this transaction. All sales are subject to the organizer's refund and cancellation policies.

6.2 Refunds and Cancellations

Refund policies are set by individual event organizers. Please review the refund policy before making a purchase. In case of event cancellation by the organizer, you may be entitled to a refund according to our platform policies.

7. Intellectual Property

7.1 Our Intellectual Property

The Services and all content, features, and functionality are owned by Experia and are protected by copyright, trademark, and other intellectual property laws.

7.2 User Content

You retain ownership of content you submit to our Services. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with our Services.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPERIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

10. Indemnification

You agree to indemnify and hold harmless Experia and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in Metro Manila, Philippines, in accordance with Philippine law.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Services after such changes constitutes acceptance of the new Terms.

13. General Provisions

  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
  • Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
  • Entire Agreement: These Terms constitute the entire agreement between you and Experia regarding the Services.
  • Assignment: You may not assign your rights under these Terms without our consent.
